Terms
These terms apply when you use Argus. They are short on purpose. If something is not clear, mail [email protected].
Who we are
Argus is a service of [LEGAL ENTITY NAME] [LEGAL FORM], registered office [ADDRESS], enterprise and VAT number BE[KBO NUMBER], RPR [COURT DIVISION].
Mail [email protected]. This address is also our point of contact for users and authorities under the Digital Services Act, in English, Dutch or French.
What Argus does
Argus gives facts about Belgian public tenders to you and to your AI assistant. The facts come from published notices, award notices, tender documents, company websites and the award reports that you upload.
Argus gives facts, not advice. It does not predict a score, it does not tell you to bid, and it does not write your proposal. You decide, and your bids are your responsibility.
Your account
Argus is for businesses only. When you register, you confirm that you act for your business, not as a consumer. One subscription covers all users in your organisation. Give correct details, and keep your password and your connected assistants safe. You are responsible for what happens through your account.
Price and trial
- Price: €29 per month per organisation, excluding VAT.
- Trial: the first 14 days are free. To start the trial, you give a payment method. On day 15 the subscription starts. It continues each month until you stop it.
- Stopping: you can stop at any time on your profile page. Your access then continues until the end of the month that you paid for. We do not refund a month that has started.
- Payment: Polar (polar.sh) sells the subscription to you as our reseller. Polar charges the price, adds VAT and sends the invoices. Polar's terms apply to the payment.
We tell you about a price change by email at least 30 days before it applies. If you do not agree, you can stop before the new price applies.
Fair use
Do not:
- resell Argus or publish its data in bulk.
- try to get data from other workspaces.
- overload or attack the service.
- upload award reports that you are not allowed to share with us, or anything illegal.
We can limit or stop an account that breaks these rules. We then tell you why, unless the law does not allow it.
The data can be wrong
Argus reads public sources every four hours. These sources can be late, incomplete or wrong, and so can Argus. Each fact has a date, so you can check it. If you find an error, mail [email protected].
Your uploads
Your award reports stay yours. We use them only to give you your analysis. Other customers cannot see them, and neither we nor OpenAI use them to train AI models.
Personal data in your uploads
Award reports can contain personal data, such as the names of evaluators or contact persons. For this data, your organisation is the controller and we are its processor. This section is our data processing agreement under Article 28 of the GDPR. We promise the following:
- We process the data only to give you your analysis, and only on your instructions. These terms and your use of Argus are those instructions.
- People who work on Argus must keep the data confidential.
- We protect the data with encrypted connections and with access limited to your workspace.
- We use the sub-processors in our privacy policy. We tell you by email before we add or replace one, so you can object. If you object, you can stop your subscription.
- We help you answer requests from the people in the data, and we help with security questions and impact assessments.
- We tell you without undue delay about a breach that affects the data.
- When your subscription ends, we delete the data within 30 days, unless the law requires us to keep it.
- On request, we give you the information that you need to check that we comply.
Liability
We work hard to keep Argus correct and available, but we cannot promise that it always is. Our liability is limited to the amount that you paid for Argus in the 12 months before the claim. We are not liable for indirect loss, such as a lost tender or lost profit. These limits do not apply to fraud, intent or gross negligence, or where the law does not allow them.
Ending
You can stop your subscription and delete your account at any time on your profile page. We can end the service with 30 days notice by email. We then refund the days that you paid for and did not use. We can end an account at once if it seriously breaks these terms.
Changes and law
We tell you about important changes to these terms by email at least 30 days before they apply. If you do not agree, you can stop before they apply. Belgian law applies. The courts of the district of our registered office decide any dispute.
